Compliance is the section most AU Shopify articles skip. It is also the section with the highest practical risk for store owners who get it wrong. This section covers the obligations that apply now and the changes that come into effect from December 2026.

Privacy Act APP 3: what triggers a collection obligation

Australian Privacy Principle 3 governs the collection of solicited personal information. Any AI tool that captures a customer's name, email address, IP address, device identifier, purchase history, or browsing behaviour is collecting personal information under the Privacy Act 1988. This includes Klaviyo (email and browsing data), Gorgias and Tidio (chat transcripts, email addresses, order data), AfterShip (name, delivery address, tracking events), and any personalisation tool that tracks customer behaviour.

The APP 3 obligation is practical: when you collect personal information, you must give the customer a collection notice explaining what is collected and why. Your store's privacy policy is the primary vehicle for this. If you install Klaviyo and begin tracking browsing behaviour for abandoned cart targeting, that is a new collection purpose that must be disclosed in your privacy policy before collection begins.

Practical action: audit every AI tool in your stack and identify what customer data each tool captures. Update your store's privacy policy to name each tool, describe what data it receives, and state the purpose. This is a one-time task that takes under two hours for most stores and removes the primary APP 3 exposure.

The December 2026 small-business exemption removal

Currently, businesses with annual turnover under AUD $3M are exempt from most Privacy Act obligations. The Privacy and Other Legislation Amendment Act 2024 removes this exemption. From December 2026, all Australian businesses that collect personal data — regardless of turnover — must comply with the Australian Privacy Principles.

This means the majority of AU Shopify stores currently exempt from Privacy Act obligations will become subject to APP 3, APP 6, and APP 11. The OAIC's Notifiable Data Breaches scheme, which requires businesses to notify affected individuals and the OAIC of eligible data breaches, will also apply to previously exempt businesses from this date.

Verify the exact commencement date with the OAIC at oaic.gov.au before publishing this article and include a "last verified [date]" note inline. The December 2026 date is from the Privacy and Other Legislation Amendment Act 2024 as enacted; commencement dates can change.

The practical advice is to begin the compliance audit now rather than in November 2026. The audit involves three actions: identify which AI tools collect customer data, obtain Data Processing Agreements from each vendor, and update your privacy policy. None of these actions require legal advice for straightforward implementations. Where your data practices are complex or where you are unsure about specific obligations, seek advice from a qualified Australian privacy lawyer.

ACL and AI-generated product content

Australian Consumer Law s.18 (Competition and Consumer Act 2010 Sch.2) prohibits conduct in trade or commerce that is misleading or deceptive or likely to mislead or deceive. Section 29 specifically prohibits false representations about goods or services, including false claims about standard, quality, value, grade, composition, or style.

AI-generated product images must accurately represent the product. Digitally enhanced imagery that misrepresents colour, size, or material features can constitute misleading conduct under ACL s.18. AI-generated product descriptions must not claim features, certifications, or attributes the product does not have.

The ACCC has taken action against online retailers for misleading product descriptions and imagery. The enforcement risk is real and is not reduced by the fact that AI generated the content. The merchant, not the AI vendor, carries liability.

Practical action: create a short review checklist for every AI-generated product description and image before publishing. The checklist does not need to be long. "Does this description make any claim we cannot verify from our own product documentation?" applied consistently is sufficient for most stores.

Data Processing Agreements with AI vendors

A Data Processing Agreement (DPA) is a contract between your store (the data controller) and an AI vendor (the data processor) specifying how they handle AU customer data. Under Privacy Act 1988 APP 11, you are required to take reasonable steps to protect personal information you hold from misuse, interference, loss, and unauthorised access. Requiring a DPA from each vendor is one of those reasonable steps.

Vendors to obtain DPAs from, at minimum: Klaviyo, Gorgias, Tidio, AfterShip, and ReCharge. Each vendor's legal resources page provides their standard DPA. When reviewing a DPA, confirm: (a) the vendor does not use your customer data to train their models without consent, (b) the vendor has security measures that satisfy APP 11, and (c) the vendor will notify you of any eligible data breach within a timeframe that allows you to meet your own NDB notification obligations.

These are integration and configuration problems, not tool problems. A Klaviyo flow without correct audience segmentation will underperform a well-configured flow by a significant margin.
